1. Agreement to Terms

By accessing or using Nitrade ("the Platform," "our services," "we," "us," or "our"), you agree to be bound by these Terms of Service ("Terms") and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using or accessing this platform.

These Terms constitute a legally binding agreement between you and Nitrade. We may modify these Terms at any time, and such modifications will be effective immediately upon posting. Your continued use of the Platform after any such changes constitutes your acceptance of the new Terms.

2. Eligibility and Account Registration

2.1 Age Requirements

You must be at least 13 years old (or the minimum age in your jurisdiction) to use Nitrade. If you are under 18, you represent that you have your parent's or guardian's permission to use the Platform and that they have agreed to these Terms on your behalf.

2.2 Account Creation

To access certain features, you must create an account. When creating an account, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Maintain the security of your password and account credentials
• Accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized use of your account
• Not create multiple accounts or share your account with others

3. Use License and Restrictions

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for personal, non-commercial purposes. This license does not include any right to:

• Modify, copy, or create derivative works of the Platform or its content
• Use the Platform for any commercial purpose without our written consent
• Attempt to reverse engineer, decompile, or disassemble any software on the Platform
• Remove any copyright, trademark, or other proprietary notices
• Use automated systems (bots, scrapers) to access the Platform
• Interfere with or disrupt the Platform's servers or networks

4. User Conduct and Prohibited Activities

You agree not to engage in any of the following prohibited activities:

• Illegal Activities: Violate any applicable laws, regulations, or third-party rights
• Harassment: Harass, abuse, threaten, or harm other users or individuals
• Fraud: Engage in fraudulent, deceptive, or misleading practices
• Impersonation: Impersonate any person or entity or misrepresent your affiliation
• Spam: Send unsolicited messages, spam, or junk mail
• Intellectual Property: Infringe upon copyrights, trademarks, or other intellectual property rights
• Cheating: Use cheats, hacks, exploits, or unauthorized third-party software in tournaments
• Manipulation: Manipulate tournament results, rankings, or match outcomes
• Data Mining: Collect or harvest information about other users without consent
• Commercial Use: Use the Platform for commercial purposes without authorization

5. Tournament Rules and Participation

5.1 Tournament Organization

Tournament organizers are responsible for establishing and enforcing their own tournament rules, prize structures, and eligibility requirements. Nitrade provides the platform but is not responsible for tournament-specific rules or disputes.

5.2 Participant Responsibilities

As a tournament participant, you agree to:

• Comply with all tournament rules and regulations
• Participate fairly and in good faith
• Respect other participants and organizers
• Accept tournament decisions and outcomes
• Report any rule violations or suspicious activity

5.3 Prizes and Rewards

Prize distribution is the responsibility of tournament organizers. Nitrade is not liable for prize disputes, non-payment, or prize-related issues. All prizes are subject to the organizer's terms and applicable tax laws.

6. Payments and Refunds

6.1 Payment Terms

When you make a purchase on Nitrade (subscriptions, tournament entry fees, products), you agree to:

• Provide accurate payment information
• Authorize us to charge your payment method
• Pay all applicable fees and taxes
• Understand that all sales are final unless otherwise stated

6.2 Refund Policy

Refund eligibility is determined on a case-by-case basis. Generally:

• Tournament entry fees are non-refundable unless the tournament is cancelled
• Subscription fees may be refunded within 14 days of purchase if unused
• Digital products are generally non-refundable
• Refund requests must be submitted within 30 days of purchase

7. Intellectual Property Rights

7.1 Our Content

The Platform and its original content, features, and functionality are owned by Nitrade and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Content

You retain ownership of any content you post, upload, or create on the Platform ("User Content"). By posting User Content, you grant us a worldwide, non-exclusive, royalty-free license to:

• Use, reproduce, modify, and display your User Content on the Platform
• Distribute and promote your User Content in connection with our services
• Use your User Content for marketing and promotional purposes

You represent that you have the right to grant this license and that your User Content does not violate any third-party rights.

8. Termination

8.1 Termination by You

You may terminate your account at any time by contacting us or using the account deletion feature in your settings. Upon termination, your right to use the Platform will immediately cease.

8.2 Termination by Us

We may suspend or terminate your account and access to the Platform immediately, without prior notice, if you:

• Violate these Terms or our policies
• Engage in fraudulent or illegal activities
• Harm other users or the Platform
• Fail to pay required fees

We reserve the right to terminate accounts that are inactive for extended periods.

9. Disclaimers and Limitation of Liability

9.1 Service Availability

The Platform is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Platform will be uninterrupted, error-free, or free from viruses or other harmful components.

9.2 Limitation of Liability

To the maximum extent permitted by law, Nitrade and its affiliates, officers, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of profits, data, or use
• Business interruption
• Personal injury or property damage
• Tournament disputes or prize issues

Our total liability shall not exceed the amount you paid to us in the 12 months preceding the claim.

10. Indemnification

You agree to indemnify, defend, and hold harmless Nitrade and its affiliates from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Platform, violation of these Terms, or infringement of any rights of another party.

11. Dispute Resolution

11.1 Governing Law

These Terms shall be governed by and construed in accordance with the laws of the applicable jurisdiction, without regard to its conflict of law provisions.

11.2 Dispute Resolution Process

In the event of any dispute, you agree to:

1. First contact our support team to attempt to resolve the dispute informally
2. If unresolved, participate in good faith in mediation or arbitration as required
3. Only pursue litigation as a last resort and in the appropriate jurisdiction

Your use of the Platform is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. Please review it carefully.

13. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Platform after such changes constitutes acceptance of the new Terms. If you do not agree to the changes, you must stop using the Platform.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
